In Canada the population is very low according to their economy, so most of the time employers over there they have shortage of staff or labour, so when employers in Canada face shortage in getting labour, the Temporary Foreign Worker Program is the solution. It means Employers is not getting relevant labour in Canada so they are hiring Foreign Worker to fulfil the need. Employers has to prove that no Canadian citizens or permanent residents are ready, willing, and able to perform the duties mentioned injob description.

So, to show as a proof they have to take an approval from LMIA (Labour Market Impact Assessment).A positive LMIA shows that there is no Canadian citizen or permanent resident to fill a position, therefore enabling an employer to hire a foreign national.A negative LMIA show that a position can be filled by a Canadian citizen or permanent resident.

Step by Step Process to take approval from LMIA

  1. Employer has to give advertisement in the paper for 6 months.
  2. Employer has to prove that he did not get the relevant experienced person.
  3. Take the approval from Employment and Social Development Canada (ESDC)
  4. Pay the required fee of CAD$1000.

Below are the following streams under which an employer can hire a foreign worker.

  • Low-Wage Workers
  • High-Wage Workers
  • In-Home Caregivers
  • Global Talent Stream
  • Foreign Agricultural Workers
  • Foreign Academics

Any employer who wants to hire a foreign worker through TFWP must get an LMIA showing that they were unable to find a Canadian citizen or permanent resident to fill the position.

International Mobility Program – Under International Mobility Program (IMP) Canadian employers can hire temporary foreign workers without Labour Market Impact Assessment (LMIA) approval. LMIA exemptions are based on the following conditions:

broader economic, cultural or other competitive advantages for Canada

To hire foreign worker under the IMP, a Canadian employer need to follow the below steps:

  • Confirm that the position or worker comes under an LMIA-exemption;
  • Pay the employer compliance fee of $230 CAD
  • Submit the official job offer through the IMP’s Employer Portal.

Low& High Wage Workers

When an employer wants to hire a temporary foreign worker who will be paid less than the median hourly wage of their province or territory then the employer must apply through the TFWP stream for low-wage workers. The first step in this process requires the employer to obtain a Labour Market Impact Assessment (LMIA) demonstrating that they were unable to find a Canadian citizen or permanent resident to fill the position.And when an employer is willing to hire a foreign worker who will be paid at or above the median hourly wage of their province or territory then the employer must apply through the TFWP stream for high-wage workers.

Foreign Agricultural Workers

When an employer is willing to hire temporary foreign workers to fill specific positions related to agricultural production can use TFWP agricultural streams to hire foreign workers. Canada offers two streams designed to facilitate the hiring of temporary foreign workers in the field of agriculture.  The NOC to apply under foreign agricultural worker is  0821, 0822, 8252, 8255, 8431, 8432, and 8611.

Seasonal Agricultural Worker Program (SAWP)

Employers those are hiring through the SAWP must meet certain requirements regarding transportation of workers to and from their country of residence, housing them during the work period, and provision of adequate workplace health and safety conditions.

Caregivers& Home support

Canadian government will launch two new immigration pilot programs for caregivers in 2019. the Home Child Care Provider pilot and the Home Support Worker pilot. The NOC comes under 4411 & 4412.

The hiring of foreign academics in post-secondary institutions can increase Canada’s quality of education as well as enable Canadian institutions to be globally competitive in terms of academic research. For this reason, IRCC and ESDC have developed a number of procedures to facilitate the hiring of foreign academics in Canada.

Easy way to get permanent residence for Foreign workers

When a foreign worker start working in Canada so they settle down theiroots in the country. These roots can be economic, social, or familial, or some combination. So the IRCC has decided to provide the facility to apply for permanent resident to foreign workers.

 

There are many immigration programs to apply for permanent resident visa. Foreign workers with at least one year of skilled employment in Canada may be eligible under the Canadian Experience Class (CEC), one of the federal programs managed under the Express Entry system. CEC candidates are well-placed to be invited to apply for permanent residence, given that Canadian work experience is rewarded under the Comprehensive Ranking System (CRS).Foreign workers who struggle to reach the CRS cut-off threshold in Express Entry draws, may have other options under one of the Provincial Nominee Programs (PNPs). Many provinces use their PNP to help foreign workers in the given province transition to permanent residence.  there may also be an immigration option for foreign workers who have established a relationship with a Canadian citizen or permanent resident, either as a spouse or common-law partner.
